Moving traffic offences: Local authorities gain new powers

Content news

This month’s Moving traffic toolbox talk focuses on this important development and the need for drivers to understand both the types of offences now enforceable and the increased likelihood of receiving penalties.

The session covers common moving traffic offences, including:

  • Driving in a bus lane during restricted times
  • Stopping in a yellow box junction, causing obstruction
  • Performing banned turns or illegal U-turns
  • Driving the wrong way on one-way streets

The key shift is that these offences have been decriminalised – meaning they are now treated as civil contraventions, similar to parking fines. This makes them quicker and easier to enforce, with fines issued directly by local councils using camera evidence.

In areas where enforcement was previously inconsistent or rarely carried out, drivers may now face greater scrutiny and a higher risk of being fined. For companies, this could mean increased admin, costs, and driver accountability.

With traffic management powers now sitting with local authorities, familiarisation with local restrictions becomes essential. Ignorance of a sign or local rule could now result in a penalty charge notice (PCN), even if the driver was unaware enforcement had changed.

This update reinforces the importance of driver awareness, up-to-date training, and clear communication of route restrictions – especially for those operating in unfamiliar towns and cities.

At a glance

  • New enforcement powers allow councils to issue fines for moving traffic offences
  • Offences now treated as civil contraventions, the same as parking fines
  • Increased risk of PCNs for bus lane misuse, banned turns, and more
